It is illegal for an insurance company to deny a claim based on something that had nothing to do with the cause of an accident.

Clearly, it doesn't stop them from trying that trick though.

My understanding is that the car has to be roadworthy as a condition to be covered and fitting  illegal aftermarket spacers makes the car unroadworthy according to the transport dept inspectors.

Yes that's right, but if you were to claim for a tree falling on your car, they cannot say they won't pay out because your car was "un-roadworthy" due to having spacers fitted.

Yes you are most likely covered in that scenario. Can tell you from 1 st hand experience that AAMI told me if I didn't have tyres as specified on the placard or better that they would not pay even if the car was legally parked and a sober driver rear ended it.

I was trying to see if I would be covered if I had H rated tyres when the placard specified V's

That is illegal and they CAN NOT do that. They have to pay you out. You can't trust anything they say!

I switched to Shannons and they were ok with that . Would rather avoid any hassles as it would be stressful enough if the car was pranged without  a bunfight with the insurer re repairs.

BTW I only have W or Z rated tyres on the car.
