Hey guys,

I hear a red lancer got wrapped around a pole at the intersection of Clayton Road and Princes Hwy. last night.

I hope it wasn't anybody from here.

Apparently it was an L-plater with 8 people in the car, 3 people on life support, other 5 walked out ok.

Be careful on the road guys!

just watched the News about it, all of them are in hospital atm..... one got thrown out of the car, front seats were also thrown out of the car...... like DAMNZ!

Turns out they were all more than old enough to know a lot better.

Dickheads, I hope they all survive, and have a good think about what they did.

Who in their right mind would want to pack into a car with 7 other people with an L-plater driving?! What a massive distraction!!! L-Platers should only have 1 passenger to monitor and assist the driver with clear and concise instructions!

I reckon the driver and the 7 other passengers should have a brain scan done whilst they are in hospital just to check if they actually have one! People can be so fkn stupid sometimes :(

This is interesting though: "A LEGAL loophole means occupants hurt in a horror smash were not committing an offence by cramming eight people into a sports coupe, the police chief says." .... "Police Commissioner Christine Nixon said so long as all of the car's seat belts were being used, overloading the vehicle with people was not a crime".

So let me get this right, 2 people were most probably in the front passenger seat using the one seatbelt to go around the both of them, and 5 people were in the back seat with a mixture of the 3 rear seatbelts wrapped around them all? bwahahaha... there would have to be a really hot chick half nekkid in the back to get me in there with an L-Plater driving lol....

wait so the law is you can have as many people as you can in a car as long as they are all encased within a seatbelt?
WTF?
how dumb are the government

If i am right in saying. You must have all seat belts used in the vehicle by only 1 body. You can not have 2 people in the one belt. But can have more people in the car than the allocated seatbelts.

If you have a passenger under a certain age, think it was 15 or younger THEY must occupy a seatbelt in that vehicle.

Its something like that.. aslong as all seatbelts are used and age restrictions met, I don't think there is anything legally wrong with it. But, i could be wrong.

What a stupid loophole... if that is the case, it should be changed.

Surely they will take into account the way the seatbelts and the car perform when overloaded in such a way.

Are you guys sure you can overload a car legally??

when was the last time a taxi said yes to 5 people?

its 2 different things

1. vic roads wont pay out to anyone over the 5 seated rule , which is on the compliance plates etc (thats what we pay rego for)

2. police law is that its not illegal to have more than 5 seated in that same car

its really silly that the vic roads and police laws are different, I guess that everyone that ever got a not wearing a seat belt fine in intitled to get there money back

I think they said that it wouldn't have been illegal had all 8 people been sharing seatbelts. If there were 5 people buckled up, and 3 people who weren't, it would have been illegal... from what i can understand anyway.

The law is as follows, had it explained at a breath test: A car may take as many passengers as it can providing that all availble seatbelts are used(by one person I believe), AND that no one is riding in the cargo area of the car(boot/ute tray).

In my view it is a geat law, I have no problem with it. I would much prefer an overloaded car with a sober driver in control of it than 3 cars on the road with one sober driver and two questionable drivers. I think it does need some taloring so that learner drivers arent allowed to do it but I have no issues with P platers doing it.

Taxis are goverened by their taxi licence(which are only issued for up to the number of availble seatbelts).

If you're that stupid to pack into a car with 6 other people with a learner driver behind the wheel, then no matter what they do to the laws or what measures or legal wording they use is going to stop you still being that stupid.

Too right. Imagine the talking, yelling, laughing, and all other distractions going on that would have baulked the driver. Frikken stupid. I thought there was a law about how many passengers a Learner driver can have in the car though???

Yeah exactly, if they did that even though its legal(which I doubt they knew) in that kind of car, I doubt any change to the law would have stopped them.
